Understanding the Orphans' Court

The Orphans' Court is a specialized probate court that oversees the administration of estates after someone passes away — whether a person dies testate (with a will) or intestate (without a will).

The Court plays an important role in ensuring that estates are administered properly, that the wishes of the deceased are honored where a will exists, and that the legal process is followed fairly and consistently for all parties involved.

In Maryland, the Orphans' Court is a court of record with jurisdiction over the probate of wills, the appointment of personal representatives, and the supervision of estate administration. Its work touches families at some of the most significant and sensitive moments of their lives.
